Fair Work Act

HIRING INTERNATIONAL STUDENTS:  The Immigration Department has advised that employers seeking to hire a primary student visa holder (with the below work limitation) must now request the visa holder provide evidence that they have commenced their course of study or training (see below):

8105 - Work limitation:
(1) Subject to subclauses (2) and (3), the holder must not engage in work in Australia for more than 40 hours a fortnight during any period when the holder's course of study or training is in session.

(2) Subclause (1) does not apply to work that was specified as a requirement of the course when the course particulars were entered in the Commonwealth Register of Institutions and Courses for Overseas Students.

(3) The holder must not engage in work before the course for which the initial student visa was granted commences.

Note: Employers seeking to hire a primary student visa holder are advised to request that the visa holder provide evidence that they have commenced their course - see subclause (3) above. Examples of evidence can include a Confirmation of Enrolment or a letter from the relevant education provider.
